Intellectual Property

All content published and made available on our App is the property of MillersMorris and the App's creators. This includes, but is not limited to images, text, logos, visual layout, code, and structure. Elements of the App are protected under law in multiple jurisdictions.

Age Restrictions

The minimum age to use our App is 13 years old. By using this App, users agree that they are over 13 years old.

Accounts

When you create an account on our App, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our App illegally or if you violate these Terms and Conditions.

MillersMorris and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the App.

Indemnity

Except where prohibited by law, by using this App you indemnify and hold harmless MillersMorris and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our App or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of Saskatchewan, Canada.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and MillersMorris are unable to resolve any dispute through informal discussion, then you and MillersMorris agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and MillersMorris.

Notwithstanding any other provision in these Terms and Conditions, you and MillersMorris agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Fair Play and Community Guidelines

Both registered and anonymous users of our website and services agree to behave with good conduct. You agree that if, at our sole discretion, we determine your account is not behaving with good conduct, you may have your access or use of our website and/or services partially or fully suspended or terminated. You further agree that if, at our sole discretion, we determine your content to have breached these Terms you may have your content partially or fully removed, hidden, deleted or otherwise made inaccessible, either to yourself and/or others.

In all circumstances, you agree that we have the right to partially or fully suspend or terminate your access to our website and services (such as banning or closing your account), for any reason without warning, and without having to substantiate, clarify or otherwise provide evidence of your breach of these Terms. You agree that this may include your account being publicly labelled as having violated our Terms if, at our sole discretion, we reasonably believe you to have done so.

Service Limitations and Availability

All use of our services are subject to reasonable caps, limits, restrictions, or other bottle-necking which are purely determined at MillersMorris' discretion. This includes private messages which are subject to a reasonable use limitation, as well as public chat messages. For more information on these points, please refer to our privacy policy.

The services available may change from time to time, and we reserve the right to amend, suspend or entirely remove any aspect or feature from our services. Our services are provided "as is" and may require your own efforts, modification, and resources to ensure they work satisfactorily. We cannot guarantee the full or partial function or full or partial accuracy of any of our services. Consequently, we cannot be held liable for any of your damage or losses sustained, of any type.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our App and the way we expect users to behave on our App. We will notify users by email of changes to these Terms and Conditions or post a notice on our App.
